Who Wants to Work on It!!
When planning on marrying a person who is not a legal citizen of the United States you will need to get a name, and background checks will need to be done before you are interviewed. It seems that this is one of the things that a lot of people don’t have done yet. When you have not had this done prior to the interview, the process may in fact take weeks to years for this problem to be fixed.
There isn’t anything that immigration can do about this problem either, because it’s actually a different agency that handles that process. You could do a Mandamus action, which is a way to try and push the government into getting the results done quicker. But usually it doesn’t really work too well.
How about if your foreign spouse will be able to work once the visa status expires? You will need to apply for a case amendment whenever you are waiting for the case to be figured out. You can get an employment document that will allow you to work, and that is anywhere that you are able to work in the US, not being limited like the H-1B visa is.
When you are due to go to your interview, you will need to make sure to be prepared and also have what is needed to prove that you are actually married. You will need to make sure that you have documents that have not only the husband’s but also the wife’s name on it. Here are some examples that would be wise to have available: Insurance like automobile or health, a mortgage or lease, deeds to land, joint bank statements, and investments that may have both your names on it, credit card accounts that have both your names on it, life insurance where one party is the beneficiary, income tax returns can be used, wills, utility bills that have both spouses on it, and wedding photo or other photographs that show you together. Perhaps the birth certificate of a child that has been born during your marriage could be used. As you can tell, the list is pretty limitless of what you will able to use. Make sure that you bring this as evidence that your marriage is a real marriage and not a marriage that was entered into, just so that one of you could obtain a green card and become a legal citizen of the United States.
So as you can tell, you need to be ready for that interview by having the paper work all filled out. Have some evidence that you can bring along that states both your names on it. With this all done and in order, it shouldn’t take very long for you to obtain your information needed to be a legal citizen of the United States. Just make sure that you aren’t trying to pull the wool over the government’s eyes, because they do not look too kindly on people who attempt any type of fraud.
